TERMS AND CONDITIONS OF HIRE

BookingsSee Shire of Yarra Ranges conditions of hire below.
PaymentPayment of bond, venue hire and insurance is due 14 days prior to the function.
Bond/DepositBookings will only be taken with payment of hire fee.
CancellationCancellations will be taken up to 7 days prior to the event. A cancellation fee of $50 will be charged for any cancellations within 7 days of the function. All other monies will be refunded within 10 working days of the cancellation.

DecorationsDecorations may be used but must be removed after the function. This includes balloons, streamers and signs/banners.
NO STICKY TAPE IS TO BE USED TO ATTACH DECORATIONS TO WALLS, FLOORS OR PAINTED SURFACES.
Set up/Pack upSet up time must be stated on the application form. Pack up should commence immediately on the termination of the function.
FurnitureDo not drag furniture across the floors. All furniture is to be returned to its original position at the completion of the function.
CleaningKitchen benches are to be wiped down.
Stove and microwave are to be left clean
All dishes to be washed, dried and put away.
Bathroom (including sink and toilets) are to be cleaned.
All floors are to be swept/vacuumed and mopped.
Rear deck is to be swept.
Rubbish is to be removed.
Lock upWhen vacating premises, all electrical appliances including lights, heaters and ceiling fans are to be switched off. BBQ is to be turned off and gas bottle returned to laundry. All windows and doors are to be closed and locked.
** Note: under EPA regulations and council policy, all music is to be turned down by 12.00am and all venues are to be vacated by 1.00am. Failure to do so can result in cancellation of the bond.

BreachesThe Committee reserves the right to expel person(s) or terminate the function due to any breach of conditions of hire and/or misconduct.

SHIRE OF YARRA RANGES CONDITIONS OF HIRE

BOOKINGS
Bookings are considered tentative until a receipt of completed application form including total hire charge. Tentative bookings will be held for 14 days.

BOND
The bond is security for any damage to the building and/or breach of conditions of hire. The total bond will be refunded to the hirer within ten (10) working days after the function, provided the hirer has complied with all aspects of the condition of hire. Should the cost of repairing damage to the property exceed the bond, the hirer shall pay additional costs. The costs of extra cleaning as a result of the function will be deducted from the bond. An account for additional costs will be forwarded within 30 days.

PERMITS
Liquor – Hirers are requested to contact the Liquor Licensing Commission on 9655 6696 to determine if a licence is required.
Gaming – Appropriate permits must be obtained by the hirer. All permits must be signed by the booking office and bookings are
subject to the appropriate permits being arranged.
Performing Rights – The hirer hereby indemnifies the Council against any claim for breach of copyright.

INSURANCE
Short Term and Casual Hire (on receipt of $25 insurance fee)
The hire includes Public Liability Insurance cover for $10 million with an Excess of $100 for property damage only. All accidents and/or incidents which may result in a claim being made under this policy of insurance must be reported to the Coordinator Risk and Insurance (Shire of Yarra Ranges) within two (2) days.
Long Term Regular Hire
The user/Hirer/Lessee shall at all times during the agreed term, be the holder of a current Public of Liability of a minimum sum of 10 million (or more). The public liability Policy shall be affected with an insurer approved by council. The public Liability Policy shall cover such risks as and be subject only to such conditions and exclusions as are approved by the council and shall extend to cover the Council in respect to claims for personal injury or property damage arising out of negligence of the user/hirer/Lessee.

DAMAGE
The floors, walls, curtains or any other part of the building or any fittings or furniture, shall not be damaged. The hirer takes steps to ensure their patrons will not cause damage or defacement. Failure to adhere to the above may result in loss of bond.

INDEMNITY
The hirer/User/Lessee agrees to indemnify and to keep indemnified, the Council, it’s servants and agents and each of them from and against all actions, costs, claims, charges, expenses, penalties, demands and damages whatsoever which may be brought or made or claimed against them, or any of them, arising from the Hirers/Users/lessee performance or purported performance of it’s obligations under this licence/permit and be directly related to the negligent acts, errors or omission of the Hirer/User/Lessee. The Hirer/User/Lessees liability to indemnify the Council shall be reduced proportionally to the extent that any act or omission of the Council, its servants or agents, contributed to the loss or liability.

LIABILITY
The hirer must (a) remain on the premises whilst visitors/patrons are in the building; (b) keep premises locked when unoccupied; (c) be responsible for orderly conduct and safety of patrons; and provide security where directed; (d) maintain the premises in a clean and safe condition for the duration of the term of hire.
Please note: the use of speed enhancers on the floor is strictly forbidden.

KITCHEN
The hirer of the kitchen shall leave it in a clean and tidy condition and all rubbish generated by the event is to be removed immediately. On completion of the function, tabletops must be cleared and wiped and the premises must be left in a clean and tidy condition.

EMERGENCY EXITS
All emergency exit doorways and passageways should be left clear at all times.
